1. Acceptance of Terms#
Welcome to TalentKonekt (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of https://talentkonekt.com and the related services, features, and functionality we provide (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
We may update these Terms from time to time. If we do, we will post the updated version on this page and update the “Last Updated” date above. Your continued use of the Platform after updated Terms become effective means you accept the revised Terms.
2. Description of Service#
TalentKonekt is a platform designed to connect candidates and employers for remote work and hiring opportunities. Depending on the features available to your account or subscription plan, the Platform may include candidate profiles, employer accounts, job postings, search and discovery tools, messaging, AI-assisted matching or recommendations, paid employer access to certain candidate information or contact features, analytics, and related services.
TalentKonekt is a platform for professional discovery and hiring-related connections. We are not a guarantor of hiring outcomes, employment relationships, candidate performance, employer conduct, or off-platform communications.
3. Eligibility#
By using TalentKonekt, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and will use the Platform only for lawful and legitimate professional purposes.
4. Account Registration and Security#
To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify us if you believe your account has been compromised or used without authorization.
5. User Roles#
Candidates
Candidates may create a profile, upload resumes or CVs, submit professional information, apply for jobs where available, and make themselves discoverable to employers through the Platform. Candidates are responsible for the accuracy, legality, and completeness of the information they provide.
Employers
Employers may create company accounts, post jobs, search for candidates, use paid features, and contact candidates through the Platform or through contact details made available as part of the service. Employers are solely responsible for their hiring activity, job content, outreach, compliance, and use of candidate information.
6. Employer Access to Candidate Information#
TalentKonekt may allow employers, including through paid plans or paid features, to view, unlock, receive, or otherwise access candidate profile information and, where applicable, candidate contact details.
Employers may use candidate information obtained through TalentKonekt only for legitimate recruiting, hiring, evaluation, and directly related professional communication purposes connected to actual job or staffing opportunities.
Employers may not:
- use candidate data for unrelated marketing, spam, or promotional campaigns;
- sell, license, publish, scrape, or redistribute candidate information obtained through the Platform;
- share candidate contact details with unauthorized third parties;
- use candidate data for any unlawful, discriminatory, abusive, or misleading purpose;
- attempt to bulk-copy, harvest, export, or compile candidate data beyond the functionality we expressly permit.
We reserve the right to suspend, restrict, or terminate employer access to candidate information if we believe such access is being misused.
7. Messaging and Communication#
TalentKonekt may provide messaging tools or facilitate direct contact between employers and candidates. Depending on the service or subscription plan, some communication may take place on-platform and some may continue off-platform once contact details are accessed or shared.
We do not guarantee responses, interviews, offers, or hiring outcomes. We are not responsible for the content, timing, conduct, or results of communications between users, especially where they occur outside the Platform. However, we may investigate reported misuse, abuse, harassment, fraud, or policy violations and take action where appropriate.
8. Payments, Subscriptions, Renewals, and Cancellation#
Certain TalentKonekt features may require payment, including subscriptions, access-based features, or other paid services. By purchasing a paid plan or feature, you authorize TalentKonekt and/or our payment providers to charge the applicable fees, taxes, and related charges using your selected payment method.
Unless otherwise stated at the time of purchase:
- subscriptions may renew automatically for the same or a similar billing period until cancelled;
- the amount, billing frequency, renewal timing, and included features will be presented before purchase;
- you are responsible for reviewing the pricing and renewal details before completing payment;
- you may cancel future renewals through your account settings or other cancellation method we make available;
- cancellation will generally take effect at the end of the current paid period unless stated otherwise;
- fees are non-refundable except where required by applicable law or expressly stated otherwise.
We may change pricing, plans, or included features from time to time. Where required, we will provide notice before changes affect a renewal or future charge.
If payment fails or a charge is reversed, we may suspend or limit access to paid features until the issue is resolved.
9. AI-Generated Features and Recommendations#
TalentKonekt may use AI-assisted tools or services, including OpenAI, to support functions such as matching, search enhancement, recommendations, ranking, profile or job analysis, and similar platform features.
AI-generated outputs are provided for informational and operational support purposes only. They may be incomplete, inaccurate, or unsuitable for a particular decision. TalentKonekt does not guarantee the correctness, quality, or fitness of AI-generated content, insights, rankings, or recommendations, and users remain responsible for their own decisions and due diligence.
10. Acceptable Use Policy#
You agree not to use TalentKonekt to:
- upload, submit, or distribute false, misleading, fraudulent, defamatory, or infringing content;
- post illegal, discriminatory, deceptive, or inappropriate jobs or offers;
- harass, threaten, abuse, exploit, or impersonate any person or entity;
- spam users, send unsolicited bulk communications, or misuse candidate or employer data;
- circumvent account limits, paid-access rules, or technical restrictions;
- copy, scrape, harvest, reverse-engineer, probe, or disrupt the Platform or its data without authorization;
- introduce malware, attempt unauthorized access, or interfere with security or availability;
- use the Platform in violation of applicable employment, privacy, anti-discrimination, advertising, consumer, or data-protection laws.
11. User Content and License#
You retain ownership of the content and information you submit to TalentKonekt, including profile information, resumes, job posts, and other materials (“User Content”).
By submitting User Content to the Platform, you grant TalentKonekt a non-exclusive, worldwide, royalty-free license to host, store, copy, process, adapt, display, distribute, and otherwise use that User Content as reasonably necessary to operate, improve, promote, secure, and provide the Platform and related services.
You represent and warrant that you have all necessary rights to submit the User Content you provide and that such content does not violate applicable law or the rights of any third party.
12. Intellectual Property#
Except for User Content, all software, design, branding, text, graphics, functionality, databases, and other content on TalentKonekt are owned by TalentKonekt or our licensors and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for its intended purposes, subject to these Terms. No other rights are granted unless expressly stated.
13. Content Moderation, Suspension, and Removal Rights#
We may, but are not obligated to, review, remove, restrict, reject, edit, suspend access to, or disable content, accounts, jobs, communications, or features if we believe they violate these Terms, create legal or reputational risk, threaten safety or security, or otherwise harm the Platform or its users.
We may take such action with or without prior notice where appropriate.
14. Data Privacy#
Your use of TalentKonekt is also subject to our Privacy Policy, which explains how we collect, use, share, and otherwise process personal data. Please review it carefully.
15. Third-Party Services#
TalentKonekt may rely on third-party tools and providers such as hosting providers, payment processors, analytics services, communications providers, and AI services including OpenAI. We may also link to or incorporate third-party services from time to time.
We are not responsible for the availability, content, policies, or acts of third-party services except as required by law. Your use of third-party services may also be subject to those providers’ own terms and policies.
16. Platform Role and No Employment Guarantee#
TalentKonekt is a technology platform that facilitates professional discovery and hiring-related connections. Unless expressly stated otherwise in a separate written agreement, TalentKonekt is not the employer, co-employer, staffing agency of record, recruiter of record, or agent of any candidate or employer.
We do not guarantee that candidates will obtain interviews or jobs, that employers will receive suitable applicants, or that any engagement between users will result in employment, contract work, or any specific business outcome.
17. Disclaimer of Warranties#
The Platform is provided on an “as is” and “as available” basis, to the maximum extent permitted by law. TalentKonekt disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
We do not warrant that the Platform will be error-free, secure, continuously available, or free from harmful components, or that user-submitted content, employer posts, candidate claims, or AI-generated outputs will be accurate, complete, or reliable.
18. Limitation of Liability#
To the maximum extent permitted by law, TalentKonekt and its affiliates, owners, officers, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, business, goodwill, opportunities, data, or expected savings arising out of or related to the Platform, these Terms, or any interaction between users.
To the maximum extent permitted by law, TalentKonekt’s total aggregate liability for claims arising out of or relating to the Platform or these Terms shall not exceed the greater of: (a) the amount you paid to TalentKonekt in the 12 months before the event giving rise to the claim, or (b) USD $100.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.
19. Indemnification#
You agree to defend, indemnify, and hold harmless TalentKonekt and its affiliates, owners, officers, employees, contractors, licensors, and service providers from and against any claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your use of the Platform;
- your User Content;
- your violation of these Terms;
- your misuse of candidate, employer, or third-party data;
- your violation of applicable law or the rights of another person or entity.
20. Suspension and Termination#
We may suspend, restrict, or terminate your account or access to the Platform at any time if we believe you have violated these Terms, misused the service, created legal or operational risk, failed to pay applicable fees, or otherwise acted in a way that may harm TalentKonekt, its users, or third parties.
Termination or suspension does not automatically entitle you to a refund except where required by applicable law or expressly stated otherwise.
21. Survival#
The following sections survive suspension, termination, or expiration of your use of the Platform to the extent applicable: Employer Access to Candidate Information, Payments, User Content and License, Intellectual Property, Data Privacy, Third-Party Services, Platform Role and No Employment Guarantee, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and any provisions that by their nature should survive.
22. Governing Law and Jurisdiction#
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Subject to applicable mandatory law, any dispute arising out of or relating to these Terms or the Platform shall be brought exclusively in the competent courts of Cebu City, Philippines.
